City staff seeks new exception to open-burning rules for large parcels

The Concord fire marshal's office asked the City Council to consider an amendment to City Code Chapter 34.4 to add an exception allowing open burning on parcels larger than 20 contiguous acres, with permits issued by the fire marshal.
Adam of the fire marshal's office said the change is intended to resolve instances in which property owners obtained county or state permits to burn but were actually inside the city limits and were later told to stop. "This came about because we've had a bunch of larger properties where they've got some land and they need to clear off, and they went and got county permits or the state permits thinking they were doing the right thing. But we go out there and they're in the city, and we tell them they have to put it out," Adam said.
Under the proposal, burning on parcels over 20 contiguous acres would be allowed only with a permit from the fire marshal. Adam told council the proposed change "aligns it with the county and state permitting issue" and would "resolve that issue." A council member asked whether the amendment simply brings the city into alignment with county and state rules; Adam confirmed it is intended to do so.
