Lebanon Board Approves Dumpster-Location Variance for Bar Louie in Gateway Marketplace

The City of Lebanon Board of Zoning Appeals on Dec. 1 approved a development-standards variance to allow a dumpster enclosure within the front setback at 1527 West South Street, where a Bar Louie is under construction in the Lebanon Gateway Marketplace PUD.
Staff planner Ben told the board the multi-parcel site is fronted on three sides by roads and that approved loading and circulation patterns make any dumpster location other than the proposed west-side spot impractical. "I will note that the applicant is not present this evening," Ben said while outlining the proposed location and enclosure materials. He added that the enclosure will be built of brick to match the building and that existing landscape buffers will partially screen the location from the interstate.
Ben said staff evaluated the request under the PUD ordinance standards (Lebanon Gateway Marketplace PUD ordinance 2018-7, section e) and recommended approval. He told the board the location would not obstruct drive aisles, would not reduce available parking and would not pose an imminent threat to public health or safety. When asked about truck access, Ben said the drive aisle is "at least 24 feet wide," allowing adequate room for refuse trucks to enter the enclosure.
Board members debated whether to proceed without the applicant present. Bruce Polley said he preferred the applicant attend; another member said weather and site constraints made proceeding reasonable. The board voted to proceed with consideration without the applicant present, then moved to approve the variance "per staff recommendation." Roll-call votes recorded Corey Coontz — Yes; Bruce Polley — Yes; Ron Edwards — Yes.
The variance relieves the dumpster-location restriction in the Gateway Marketplace PUD and allows the dumpster to be located between the restaurant building and the interstate-facing side of the lot. Because the applicant was absent, the board accepted staff testimony and the record indicates the variance was approved; the applicant may still need to satisfy any building or site-permit conditions with city staff.
The board did not set further conditions on the variance during the meeting. The decision is effective per the city's approval process; any additional permit approvals or inspections will be handled by staff.
