In CE25050004 (14872 Gruber Lane), the town presented evidence that land clearing and filling occurred outside permitted activities and that a Floodplain Development Approval (FDA) was required. Respondents acknowledged an FDA application had been submitted but said it had outstanding comments and that engineering revisions were underway.
Town permitting staff reported review comments and that the application had not yet been approved; the magistrate noted the case had been ongoing and that issuance — not merely application — of the FDA is the compliance metric. After entering both sides' exhibits, Magistrate Barnard ordered the respondent to have the FDA permit issued on or before Feb. 27, 2026. If the permit is not issued by that date, a $250/day fine will start Feb. 28; the magistrate set a fine assessment hearing if necessary.
