Court adopts conditional‑use court order for Waste Management and continues host‑fee review

The Gilliam County Court on Dec. 3 adopted Court Order 202501, which modifies conditions of approval for a five‑year conditional use permit previously issued to Waste Management Disposal Services. Planning staff reminded the court the planning commission held a public hearing Nov. 5 and recommended the conditions now before the court.

Chair read highlights of forthcoming host‑fee and road‑use agreement negotiations. The court said the agreement is under legal review, with a plan to bring a finalized document back on Dec. 17; staff noted Waste Management’s legal counsel is reviewing the proposed language and that the company has agreed to a short extension if needed.

Chair provided fiscal context: Waste Management currently pays about $2,454,000 in property taxes in the county and, with a proposed gas plant addition, could see property‑tax payments exceed $3,000,000. Staff estimated combined host fees and increased taxes could approach higher seven‑figure levels and said the county is proposing modified exemptions to prevent industrial wastes (for example, wind‑turbine components) from being accepted at no cost if that was not originally intended by the host agreement.

Under the proposed road‑use arrangement, Waste Management would pay 80% of the costs of road maintenance connected to its operations; other changes would move operational items from the host‑fee agreement into the conditional‑use permit as appropriate.

The court adopted the court order as presented and will take up the host‑fee and road‑use agreement again once legal review is complete.
