Seminole County board vacates unnamed right of way in Palmer Subdivision

The Seminole County Board of County Commissioners unanimously approved a resolution on Dec. 11 to vacate and abandon an undeveloped portion of an unnamed right of way in the Palmer Subdivision.

Caitlin Apgar of Planning and Development Services told the board the applicant, Constance Silver of Tri Civil Engineering Design Studio, represents owner Jesus Image Incorporated and petitioned the county to vacate the right of way recorded in plat book 2, page 41 of the public records of Seminole County. Apgar said the area in question lies about 1,200 feet west of Sipes Avenue, adjacent to the south perimeter of Lot 15 and the north perimeter of Lot 22, and that vacating the right of way will not landlock adjacent parcels.

Apgar also told commissioners the request complies with Seminole County Land Development Code section 35.184 and cited Florida Statutes 336.09 and 336.1 as the state authority related to right‑of‑way vacations. The presentation concluded with staff recommending adoption of the resolution.

The chair opened public comment; no signed public comment form was submitted. Applicant Constance Silver said she was present to answer questions. Commissioner Zimbauer moved to approve the resolution and the motion was seconded. The chair called the vote and the motion carried unanimously.

The resolution directs county staff to record the vacation consistent with the description in plat book 2, page 41. The board did not discuss any conditions or amendments to the staff recommendation during the vote.

The board moved on to subsequent agenda items after the vote.
