Marshall County commissioners took two distinct legal steps Dec. 15: they agreed to sign a quitclaim deed resolving a contested small shoreline parcel on the west shore of Lake Maxinkuckee and elected to table a proposed purchase and debt-retirement package tied to the MCRSD sewer district until settlement momentum is clearer.
County counsel reported a McKesson Title search and a review of historic minute books found no reliable county title to the disputed Runau West Shore parcel. Counsel recommended, and commissioners approved, executing a quitclaim deed that relinquishes any county interest and allows neighboring property owners to clear title; the president was authorized to sign.
Separately, staff outlined an option to purchase the MCRSD loan package to retire sewer debt. Counsel said settlement negotiations have produced a potential framework but financial and accounting questions remain about running a roughly $2 million transfer through county books and bank-timing during the holidays. Commissioners voted to table Resolution 2025-14 and directed continued coordination with the county council, treasurer and counsel to align timing, reporting and settlement steps.
County counsel said he had filed a motion to intervene in an IDEM appeal to protect county interests in the sewer-district dissolution appeal unless a settlement negates that need; an executive session with the county council was scheduled to discuss the proposed settlement.
