Board tables proposed ordinance to allow shelter roofs on private piers after public objections

The Board of Supervisors on Dec. 11 tabled a proposed amendment to the county’s pier and boathouse ordinances that would have allowed 'shelter roofs' on private, noncommercial piers up to 400 square feet and 20 feet in height.

Planning staff introduced the ordinance changes and said the planning commission had unanimously recommended approval after review. The proposal would make shelter roofs a by-right use except in R-1 zoning (and include conditional-use review where adjacent landowners object).

Multiple residents and waterfront property owners spoke at length in opposition, citing concerns about obstructed views in narrow creeks, increased noise and nuisance from covered gathering spaces, the risk that roofs and debris become hazardous in storms or hurricanes, and the potential for increased litigation among neighbors. Local speakers also urged county staff to solicit the Virginia Marine Resources Commission (VMRC) technical advice and to clarify notification rules for properties across narrow waterways.

Board members questioned whether the ordinance aligned with VMRC rules and discussed whether to make pier roofs conditional-use rather than by-right to provide broader public oversight. Given the technical questions and strong public comment, a motion to table the ordinance and seek further input — including direct VMRC guidance and neighborhood outreach — carried by voice vote.

The planning commission will be asked to gather the VMRC opinion and the board expects a future return of the item with additional analysis.
