Kootenai County commissioners on Dec. 18 approved additional language to the City of Hayden law‑enforcement contract addressing equipment ownership, termination for unsatisfactory ordinance enforcement, and related transition details.
The board added language to exhibit B specifying equipment—"vehicle radios, camera system, vehicle upfitting, and other miscellaneous equipment purchased by the city and utilized for patrol"—would either be returned to the city or reimbursed if it cannot be returned. A county representative noted some equipment may be proprietary to third‑party contracts such as Motorola and that the parties would have to determine what can be transferred.
Commissioners also removed a sentence that referenced the county prosecutor's opinion about enforceability of the city's ordinances. In addition, the board agreed to permit the city to terminate the agreement "notwithstanding section 1.6" with 3 days' written notice if the city determines enforcement of its ordinances is unsatisfactory; that change preserves a 60‑day transition plan for implementation while enabling a quicker initial notice. A county official said transition costs and billing would be handled per the transition plan and that the date the county receives notice would trigger the transition period.
A motion to add the proposed language to exhibit A and exhibit B passed by voice vote. Legal counsel was asked to tidy comma placement and integrate the agreed phrasing before the county sends the amendment to the city.
