The Norwalk Zoning Board of Appeals approved a revised variance Dec. 18 for property owner Danielle Hogan to locate a proposed in-ground pool at 222 West Rox Road after the applicant modified the plan to eliminate a front-setback request and reduce the side-setback encroachment.
Staff reported the revised plan places the pool farther from the front property line and reduces the side-yard variance request from the originally proposed 16.6 feet to 21 feet from the side property line, while noting that previously constructed retaining walls do not meet a 10-foot setback and the survey did not include wall heights; staff therefore could not determine whether additional compliance issues exist for the walls.
Applicant Danielle Hogan described steep topography, a buried French drain and ledge rock in the rear yard that make rear placement infeasible and explained she would address retaining-wall issues at a later date. “There are severe rear access limitations, so there’s no back entry to, from our home,” Hogan said when presenting hardship and safety considerations.
No public opposition was raised during the hearing and the board voted unanimously to approve the application as revised. The board recorded that retaining-wall compliance must be addressed separately during subsequent permitting or enforcement review.
Next steps: the applicant will submit detailed plans and address retaining-wall information (including heights) before final building permits can be issued.
