East Ridge council approves release of 1971 right of reverter on hospital-area parcel

The East Ridge City Council voted unanimously to approve Resolution 37-67, authorizing the city to release a long-standing right of reverter tied to property originally conveyed to East Ridge General Hospital in 1971.
City counsel reviewed historical deed language and told the council the reverter condition — which required hospital or medical-office construction within a period in the original conveyance — appears to have been satisfied by subsequent development. Counsel said the title company and lender requested a release to clear any perceived encumbrance and simplify title. "They want them to be simple with good marketable title," counsel said in explaining the request.
Council members asked clarifying questions about other easements on the parcel and whether the release would affect street, sewer or other conditions. Counsel stated that the action would not affect 40-foot street or sewer easements that remain on the property and that the release would only eliminate the city's historic right of reverter.
The motion to approve Resolution 37-67 was made by Council member Witt and seconded by Vice Mayor Tyler. Roll call votes were Yes by Vice Mayor Tyler, Council member Cagle, Council member Ezell, Council member Witt and Mayor Williams; the resolution was approved.
The council noted the action removes an outdated title encumbrance and will ease lending and development transactions on that parcel going forward.
