Englewood staff updated the Water and Sewer Board on a recently negotiated settlement in a water-rights court case affecting downstream depletion timing and the city’s rights on the South Platte.
Staff said the settlement was coordinated with multiple opposers and that timing required rapid response. "We are receiving almost $80,000, 79,000 and some change to cover, our core cost," staff said, explaining those funds reimburse the city for Burk(e) Hill and Martin and Wood litigation-related costs. Deputy City Attorney McDermott said approving the settlement scaled back the Rainview project timeline and imposed stricter conditions, "thereby protecting Englewood's rights on the South Platte," and confirmed the negotiated reimbursement.
Staff characterized the result as good news and offered to answer board questions; no additional action was taken beyond the informational briefing at the meeting.
