Planning commission approves time extension for Marketplace vesting tentative map amid litigation

The San Ramon Planning Commission on Dec. 16 approved a time extension for the Marketplace mixed‑use project’s vesting tentative map while a legal challenge proceeds. Staff told the commission the extension is a time‑only stay and does not alter project conditions or findings.
City staff explained the vesting tentative map for the Marketplace project was set to expire on March 14, 2026. The applicant requested a stay of the vesting period while a legal challenge to the project is pending in the California Court of Appeal. Staff recommended the commission adopt planning commission resolution (packet cites “18‑25”) to pause the VTM timeframe for the period of the pending legal challenge, for up to five years.
A member of the public, Greg Carr, urged the commission to deny the extension, calling the project “wrong in so many ways” and saying the applicant “didn’t get your stuff together, and the clock’s up.” Commissioners and staff said the action is procedural and consistent with legal advice; one commissioner noted the city attorney recommended extending vesting during resolution of the case. A motion to accept staff’s recommendation was moved and seconded and the resolution was passed.
Staff also reminded the public that planning commission decisions may be appealed to the city clerk within 10 calendar days with the appropriate filing fee.
The vote was procedural and did not change the project’s substantive approvals. The commission moved on to the Orchards master plan public hearing afterward.
