Marion County commission approves statewide mutual aid agreement

Marion County commissioners approved a statewide interagency mutual aid agreement after a discussion about legal authority, logistics and the agreement's practical effects.

The measure — presented as a template from the state Emergency Management Agency (EMA) and supported by local mutual-aid organizations — will allow the county to participate in preplanned and emergency mutual-aid operations with neighboring jurisdictions. Proponents said the agreement clarifies liability protections and can allow certain procurement rules to be suspended during declared emergencies.

Russ, who explained the statewide template to the commission, said: "The statewide mutual aid agreement allows us to do that for preplanned events." He described the agreement as covering both emergency and non-emergency events and said it stems from recent legislative changes requiring governing-body signoff on certain mutual-aid documents.

Scott, who reviewed the draft resolution with the commission, said the recommended approach mirrors steps taken in other counties and noted: "Every time we've adopted one of these things, we've always authorized the M.A. director to sign these type of agreements." Commissioners discussed whether to sign the template now and pass a second, follow-up resolution authorizing the EMA director to execute additional memoranda of understanding or agreements.

Commissioners asked about timing and logistics for emergency signings; proponents said adopting the statewide agreement would reduce the need to convene special-call meetings in the middle of an event because preauthorizations would already be in place. Commissioners cited prior local responses (including tornado cleanup agreements) as examples of where clarified authority and liability protections helped or would have helped operations.

A motion to approve the agreement passed by voice vote; the commission recorded the motion and second and stated "All in favor." Commissioners indicated a separate resolution to specifically authorize the EMA director to execute related MOUs/MOAs would be prepared for a future meeting.
