After nearly four hours in executive session, the Nueces County Commissioners Court returned to public session and took several actions Dec. 10.
Lease ratification: Commissioner Brent Chesney moved to ratify the county judge’s executed acknowledgment of delivery related to the lease of 1315 Comanche Street; the court approved the ratification unanimously (SEG 3624–3633). "I would make the motion to ratify the acknowledgment of the delivery document executed by the county judge related to the lease of 1315 Comanche Street," Chesney said when making the motion (SEG 3624–3626).
Salary irregularity remedy: On personnel matters originating from a Workday payroll irregularity, the court approved a remedy allowing the affected employee to exhaust accumulated paid time off in exchange for repayment of the overpayment. The motion passed unanimously (SEG 3635–3645).
Newport Pass sale authorization: Commissioner Matas moved to authorize the county judge to negotiate the sale of Newport Pass Park (11093 State Highway 361) with a governmental entity and, if unsuccessful, to begin competitive sale procedures and publish required notices under the Local Government Code and Texas Parks and Wildlife Code. The motion carried with four ayes and one abstention (SEG 3649–3661).
Legal engagement: The court ratified an engagement with Chavez, Arbagon & Perales (attorney Marsha Perez) to research the county’s obligations tied to a section of West Riverview Drive and related public‑dedication questions; the motion passed unanimously (SEG 3676–3684).
Why it matters: These post‑executive session actions address immediate legal, personnel and real‑property matters and give the county judge authority to negotiate a high‑priority sale while ensuring follow‑up oversight by the court.
Next steps: County staff will proceed with required notices, potential public hearings and any procurement steps if the Newport Pass sale is opened to competitive bid; the judge was authorized to execute related sale documents when appropriate (SEG 3649–3661; SEG 3568–3579).
