DRC reviews reapplication for Joy Childcare special-exception at Chandler Road

Junson, a planner with the community development department, told the Development Review Committee on Dec. 10 that the applicant has requested a special-exception permit for a childcare facility at 4410 and 4420 Chandler Road on a combined 5.12-acre parcel in RSF-1A zoning. "The applicant has requested a special reception permit for a for a childcare facility at 4410 And 4420 Chandler Road," Junson said, noting that the planning commission approved the permit on 05/13/2025 but that the applicant had reapplied.

Junson said the property is designated residential very low suburban and that, "per LDC 4.2 0.2 point c," a childcare facility is permitted in RSF-1A with approval of a special exception. The planner told the DRC the applicant reapplied because "certain conditions that are required by planning commission are difficult to meet the code."

The DRC chair and staff explained that the planning commission had added conditions requiring improvements to Chandler Road adjacent to the property. The chair noted that "Chandler Road's a private right of way, so that's why the applicant's reapplying for the special exception because they didn't agree with that condition of approval." No applicant representative offered further comment at the meeting.

Departmental reviewers recorded no objections on the record: community development and police had no additional comments, and public works and fire reported no objections during the DRC discussion. The DRC did not record a formal vote or final action on the reapplication during this session.

Next steps: the reapplication remains under review with the DRC record noting the dispute over the Chandler Road condition; the applicant intends to pursue the special-exception process to address the planning-commission condition.
