Board authorizes potential legal action to challenge City of Cheyenne stormwater fee

A trustee moved and seconded a motion to authorize the district to file legal action as needed to determine the legality and applicability of the City of Cheyenne’s stormwater fee. The mover said board members had previously tried to engage city council members about objectives and opportunity to collaborate but had not reached a resolution. Following discussion, the board voted in favor and the chair declared the motion approved.

The motion authorizes the administration and legal counsel to pursue whatever legal steps are necessary to test the fee’s applicability to the district. Trustees did not provide a schedule for litigation or a requested dollar figure for legal expenses during the public discussion; the motion concerned authority to proceed and was not itself a judgment on the fee’s merits.

The board then approved routine consent items and subsequently voted to enter executive session for student, personnel and legal matters.
