One councilor described the surface facts as "a city vehicle destroys private property" and said they were uncomfortable with a denial without more information. Other members noted the procedural necessity of formally denying the claim before the statutory deadline to preserve a particular statute of limitations and that denial would not foreclose later settlement discussions.
The council ultimately adopted an amended motion (deny the claim and schedule a closed session on August 19) by a 5–2 vote.
