Spencer County Fiscal Court voted Dec. 1 to approve Resolution No. 11 and to submit an interlocal agreement between the Spencer County Sanitation District and the City of Taylorsville to the Kentucky Attorney General for review.
County staff and sanitation-district representatives explained the agreement implements KRS 220 provisions allowing a sanitation district, after notice and procedures, to ask the municipality that furnishes water service to cut off that user’s water until delinquent sewer charges (plus disconnect/reconnect fees) are paid. Staff said the Department for Local Government had reviewed the draft and offered approval; because the sanitation district is a special-purpose government entity, attorney-general review is required before final implementation.
Corey (staff) described usual delinquency procedures: a multi-month delinquency, a notice and a 30‑day opportunity to cure, and case-by-case consideration of customers showing good‑faith partial payments. Commissioners asked for clarification on the threshold that triggers disconnection; sanitation staff said a typical trigger would be several months of unpaid invoices and noted the district typically attempts outreach and work‑out plans before disconnection.
The court voted to authorize submission of the agreement and the accompanying resolution to the Kentucky Attorney General to secure the AG’s review and approval, enabling the sanitation district to use the statutory remedy where appropriate.
Next steps: The agreement will be formally submitted to the Attorney General’s office for review. The sanitation district will follow statutory notice procedures before any disconnections.
