The Gary Common Council voted unanimously to deny CPO-2025-61, a petition by Francois Lubin seeking to vacate a public right-of-way along Fairbank Street and nearby 17th Avenue.
Attorney Carla Molina summarized the petition and reminded the council that the Planning Commission had reviewed the request on Sept. 18 and issued a 6–0 unfavorable recommendation. "This matter came before the plan commission… it voted a 6 to 0, with an unfavorable recommendation, to vacate the public right of way," Molina said during the overview.
After brief discussion and no further public speakers on the item, the council recorded votes that produced 0 yes and 8 no; the clerk announced the ordinance failed.
The petition will not move forward; the council did not provide further direction to staff on mitigation or alternative actions during the meeting.
