Kenmore staff and consultant teams presented proposed updates to Title 18 (Critical Areas) focused on stream riparian management zones (RMZs), explained Department of Fish and Wildlife (WDFW) guidance, and reviewed three buffer policy options for council consideration.
Assistant City Manager and Community Development Director Debbie Bent and principal planner Todd Hall framed the session as an exploratory conversation: staff said they were not seeking direction at this meeting and planned to return in 2026 with draft amendments and a public hearing schedule. Consultants from Osborne Consulting and Facet outlined the three options:
- Low: a WDFW‑approved urban baseline that increases impacted acres and parcels modestly over current rules and is described by staff as meeting minimum BAS (best available science) for urbanized areas. - Medium: a 200‑foot protection standard with an enhancement‑based reduction to 150 feet if applicants enhance the entire buffer area to specified native cover thresholds (e.g., 80% native plant cover, invasive species <10%). The medium option is framed as meeting BAS while providing an explicit enhancement pathway. - High (SPTH): a site potential tree height methodology that measures buffers by the projected 200‑year tree height (up to ~231 feet in some mapped locations). Consultants described this option as the most protective but administratively complex and potentially expensive for applicants because of site‑specific validation requirements.
Consultants and staff presented GIS outputs prepared by the city's GIS analyst showing that the existing code affects about 10% of parcels, while the low option would affect ~15%, medium ~18%, and high ~22% of parcels. Staff emphasized that maps are a high‑level dataset from WDFW and NRCS and that ground‑truthing or qualified professional reports would be required for parcel‑level determinations during permitting.
Council questions covered data completeness, how vesting would apply (complete applications prior to adoption would vest under current rules), reasonable use exceptions (single‑family reasonable‑use allowances would remain), potential incentives (height, density or lot coverage tradeoffs and voluntary restoration incentives used by other jurisdictions), monitoring requirements for enhancements (multi‑year monitoring obligations), and staffing/cost implications. The city attorney reminded the council that "best available science" is a spectrum and that multiple options can comply with the Growth Management Act.
Council members expressed a range of policy preferences: some favored the high option for stronger protection of streams; others supported the medium option for predictability and to limit administrative burden and uneven parcel impacts. Several councilors requested staff provide additional information before any direction: a clearer table of parcel and unit impacts, estimates of additional staff time and costs for each option, outreach materials and timing, and proposals for incentives and implementation rules. Staff said they would return with more information and options for public engagement in 2026.
No ordinance or formal direction was adopted at the meeting.
