APC staff outlines variance findings and common pitfalls to the ABZA

TIPPECANOE COUNTY, Ind. — Staff from the Area Plan Commission delivered a planning-pointer presentation to the Area Board of Zoning Appeals on Dec. 3, walking board members through the first four findings required under the Unified Zoning Ordinance and Indiana Code when considering variance requests.

Staff emphasized that petitioners must provide findings addressing the same tests staff applies: (1) the determination that a request is not a use variance (use variances are prohibited under state law for the area board), (2) whether granting the variance would injure public health, safety, or general welfare, (3) the effect on the use and value of adjacent properties, and (4) whether the terms of the ordinance are being applied to an uncommon situation for that zoning district.

Using a 2014 example involving a roofed front porch granted a reduced front setback, staff illustrated how lot shape, size (an example lot was 5,070 sq ft), topography, utilities such as septic fields, and historical platting can bear on the findings. The presentation reminded members that staff reports are prepared from site visits, neighborhood context, and any public input received.

Board members asked clarifying questions about septic locations, how porch areas are counted toward coverage, and how different neighborhoods may have higher coverage in practice; staff said they would correct agenda date errors and provide additional materials as needed.

The presentation was informational and did not itself change policy; the board proceeded to hear and decide two variance petitions afterward.
