Committee delays plat review for Missouri Valley Complex until city–county planning agreement is finalized

Members of the Missouri Valley Complex Committee agreed to pause their plat review and related planning work until a pending city–county agreement clarifies which authority will regulate the site, committee members said at the meeting.

Commissioner Munson told the committee the city and county are negotiating an agreement that would allow early county planning and zoning authority over the Missouri Valley Complex. "I'd rather hold off on Swenson and Hagen a little bit and make sure that agreement is in place with the city," Munson said, explaining the committee would then submit the plat to the authority that will make the final decision.

The committee heard a presentation from a Swenson Hagen representative, speaking on behalf of Jason Patrisian, who said wetland permitting requirements and jurisdiction will determine stormwater and infrastructure design. "We would like to hold on the plat until we know what our jurisdiction is," the consultant said, noting that differing requirements between city, county or ETA oversight would change stormwater management plans and permit terms.

The consultant and committee members discussed infrastructure questions that depend on the jurisdiction decision, including road layouts, maintenance responsibility, and whether city sanitary sewer and water service would remain available if the county assumes control or whether rural utilities would be required. The consultant recommended preparing the wetland permit and getting the contract out for bids now, while holding the plat submission until jurisdiction is settled.

Committee members also asked about potential federal changes to wetland standards. The consultant said such national-level changes can lead to court actions and regulatory uncertainty and could delay local mitigation and permitting, but advised proceeding with permit work where possible to avoid longer delays.

Next steps recorded at the meeting: committee members will watch the city council action on the draft agreement and, once the jurisdiction decision is known, staff will return the plat for review, advance permit procurement and coordinate meetings with county planning and county highway staff to align infrastructure design and stormwater planning.
