The board amended a prior variance on case 4348 to add a 10‑foot relief that, combined with an earlier 5‑foot allowance, will result in the new unit sitting 5 feet from the property line.
Mattern, who said the property at 5885 Franklin Road is her residence, told the board the replacement unit “is being put in the same spot. It’s just longer,” and asked for the change so she can “provide a new home for my family.” Staff had told the board a field measurement showed the practical need would be a 10‑foot additional variance and that the original plat did not reflect the new proposed dwelling’s footprint. Staff’s recommendation to deny was based on language in the zoning order.
Neighbors and a local property owner spoke during the hearing about the lot’s history and access. One neighbor described the lot’s narrow shape but said emergency access would not be compromised. Board members discussed the chain of title and whether the lot’s creation predated current zoning; the chair noted a legitimate hardship exists if the chain of title dates back prior to the zoning ordinance’s effective date, which the board found persuasive in this case.
After an amended motion to approve the additional 10‑foot west yard setback was made and seconded, the board voted in favor and the motion carried.
The approval is limited to the relief granted in case 4348 and does not change other zoning obligations for the property. The applicant or any affected neighbor may pursue further administrative remedies under county procedure if needed.
