Nancy from the county’s Ditch and Agriculture office summarized the application and said it repeats conditions from a prior 2012 agreement: the applicant may perform maintenance on the main ditch but may not drain the unnamed DNR water body at the inlet or outlet. Nancy said the resolution will explicitly prohibit draining and require the applicant to repair any DNR‑related damage; if the applicant fails to repair the property, the county may assess the property to cover corrective work.
"He will not be allowed to do that again. He'll not be allowed the same as last time to clean the inlet or the outlet," Nancy said, describing the language that will be included in the resolution.
After staff presentation there was no board debate and the board approved the hold‑harmless agreement by voice vote.
Next steps: county staff will finalize the resolution language reflecting the cited DNR restrictions and the applicant will proceed with maintenance at his own expense.
