Todd County planners to take draft cannabis ordinance to planning commission after board discussion

Todd County planning staff presented a draft revision to the county’s cannabis ordinance during a Dec. 16 work session, asking the board for direction and recommending the draft be sent to the planning commission.
The draft would remove cannabis businesses from AF‑1 and AF‑2 zoning and limit several uses (manufacturing, wholesale, transportation and retail) to commercial zoning only, while staff proposed new application requirements for conditional use permits (CUPs). Planning staff also proposed prohibiting outdoor advertising/display and adding standards on lighting, parking, hazardous material storage and limits on movable retail operations.
Commissioners discussed whether the state might require outdoor cultivation options and whether cultivation should be classified differently (indoor cultivation in commercial zones vs. potential agricultural/acreage cultivation). One commissioner asked staff to review any state mandates that could affect local zoning for outdoor grows. Commissioners also suggested reviewing fee schedules for CUPs to reflect regulatory complexity.
Planning staff recommended public hearings and a planning commission review; the board generally supported forwarding the draft to the planning commission for formal review and public comment. Planning staff noted a planning commission deadline would allow the ordinance to be on the commission’s Jan. 8 agenda if the board so directed.
