Committee recommends approvals for Middleton Shores and Conservancy Bend developments with deferred effective dates and standard conditions

The Middleton Public Works committee recommended that the finance committee and common council approve city developer agreements, certified survey maps (CSMs) and site plans for two multi-building developments — Middleton Shores and Conservancy Bend Phase 2 — subject to standard deferred effective-date conditions.
For Middleton Shores staff said the project requires about 300 feet of public water main along a shared lot line to serve multiple apartment buildings; because the main will serve multiple buildings the water main must be public. The sanitary sewer for that project will be private and served by a private lift station that the city will not maintain; staff and the committee confirmed the city will still inspect plans and perform building inspections. The committee moved to recommend approval of the developer agreement and the CSM with the condition that plan drawings, public-improvement surety, city-engineer satisfaction and any outstanding staff comments be completed; the motion specified a deadline that would void approvals if the items were not completed by Sept. 1, 2025.
On site-plan details for Middleton Shores, staff described a central stormwater-management area intended to meet green-space and impervious-surface requirements; Water Resources and the city's outside reviewer (MSA) recommended approval. Members pressed on neighborhood notification practices for planned water shutoffs; staff said residents receive 48-hour notice and can sign up for email or text alerts through CivicPlus.
On Conservancy Bend Phase 2, staff said public improvements will include at least a public water main and sanitary sewer serving multiple lots. The committee asked about "televising" sanitary sewers; staff explained crews use a small camera driven through pipes to visually inspect sewers after installation and for maintenance. Members also raised the fee-in-lieu for parkland; staff said such fees are typically deposited in a separate fund for park acquisition or construction and offered to check local practice in Middleton.
Site-plan discussion for Phase 2 noted a parks request for a fence along the northern property boundary and a plan-sheet discrepancy that showed electric in a water-main easement; staff said the city does not allow electric in water-main easements because of conductivity concerns and that the discrepancy is being corrected. The developer representative (Taylor) asked whether the Sept. 1, 2025 void date applied to construction; staff clarified the date applies to completing approval items and does not require construction to be finished by that date.
Committee motions to recommend approval of the developer agreements, CSMs and site plans for both developments (each with deferred effective dates and the Sept. 1, 2025 void-if-not-complete condition) were moved, seconded and carried.
The recommendations will be forwarded to the finance committee and common council for final action; city staff said outstanding clerical items and minor comments remain to be resolved before final signatures and that the city attorney will review agreements when appropriate.
