Staff said the amendment arose because the applicant seeks to allocate two existing hotel units into condominium units and to record condominium documents to facilitate shared parking and utility arrangements.
Board members pressed the applicant to clarify how obligations tied to the city's original conditions of approval (maintenance of pump stations, shared utilities, parking) will be enforced if ownership structures diverge in the future. Members also requested a financial assurance: staff and one board member noted they had not yet received the applicable letter of credit in the application packet; the applicant later said a $3,500,000 letter of credit exists but the document was not included in the filing package.
Given those gaps, the board voted to continue the application completeness review and schedule a public hearing for Jan. 6, 2026, asking the applicant to provide: (1) the bank/financial documentation demonstrating financial capacity (letter of credit or similar); and (2) clarity in condominiums/condo documents or conditions that make the obligations enforceable by the city across both units and future owners.
Next steps: Applicant will submit the requested financial documentation and condominium documents; staff and the city attorney will confirm whether conditions of approval should be restated or amended to bind both condominium units and address long‑term maintenance responsibilities prior to the Jan. 6 public hearing.
