The Village of Waukesha Board on Dec. 11 granted the Barton family a final, staggered extension to bring a Genesee Road property into code compliance, setting a Jan. 31, 2026 deadline specifically for reroofing and an April 15, 2026 deadline for remaining painting and cleanup.
Property owner Jim Barton told the board he has removed most debris and outbuildings and is under contract with Weather Pro Exteriors to replace the roof; he said painting is approximately 90% complete but weather and a contractor no‑show delayed final work this fall. A contractor working on the site told the board crews removed seven buildings, hauled multiple semi‑trailers of concrete rubble and several loads of scrap, and salvaged or sold farm implements. Barton asked for more time to finish remaining tasks, including spreading fill where two buildings had been removed.
Board members expressed frustration that the roof issue had been discussed publicly for months. Staff noted the property was previously put on notice and that, if a vote to extend were not approved, enforcement would move to citation with daily fines. During the discussion members and staff said daily fines for citations could be roughly $1,000–$1,300 per day and that, in some cases, citation fines can be pursued retroactively to the date a violation was first documented. Members acknowledged visible progress on site but emphasized that repeated extensions set a precedent the board must consider.
After debate, the board approved a motion establishing the staggered deadlines: the roof must be completed by Jan. 31, 2026 (after which daily fines may begin), and all remaining required work — including finishing paint and filling/cleaning remaining holes — must be completed by April 15, 2026. Members said that if Jared (the building inspector) does not sign off on compliance by those dates the citation process would proceed and fines could be assessed according to existing enforcement practices.
What happens next: Barton said he will attempt to get Weather Pro Exteriors on site and asked staff to note the record; village staff will monitor compliance and Jared will inspect and sign off if the work is complete. If work is not complete by the stated dates, the village attorney and prosecuting authority may pursue citations and daily fines.
