The City of Encinitas Planning Commission on Jan. 7 voted unanimously to forward proposed zoning and local coastal program amendments to the City Council that would update on‑site parking rules for single‑family residences to conform with Assembly Bill 1308. Senior planner Charlotte Brenner told commissioners the change is needed because the city's current code can require additional on‑site parking when floor area exceeds 2,500 square feet, a requirement that conflicts with the state law.
Brenner said the amendment would revise Title 30 (including the Encinitas Ranch specific plan) and cited Government Code section 65863.3 as the state authority limiting local parking exactions for qualifying remodels. She noted staff opened the six‑week public review period (Nov. 21, 2025–Jan. 2, 2026) and had not received comments as of the hearing.
The commission asked no substantive questions. An unidentified commissioner moved to adopt Resolution No. 2025‑35 to recommend that City Council adopt the implementing ordinance (listed in the staff packet as Ordinance No. 2026‑01); the motion carried 5‑0.
