Late in the Dec. 15 meeting, the Cedar Falls City Council voted to go into executive session to discuss strategy with legal counsel for matters that are currently in litigation or where litigation is imminent. The motion cited Iowa Code §21.5(1)(c), and the clerk recorded the motion as carried on roll call. The mayor noted no further public business would be discussed while the council met in executive session and the council would return to the public meeting only to adjourn.
The council did not disclose details of the litigation or litigants in the public session. Executive sessions held under Iowa Code §21.5(1)(c) are authorized to allow the city to discuss litigation strategy with counsel where public disclosure would likely prejudice the city's position.
