"They're moving forward at a pretty good clip and they're getting good information from the departments," Speaker 5 said, describing JLG's deliberate three-meeting approach to gather space needs before finalizing plans. Speaker 5 told the committee JLG suggested bringing a contractor in on a limited consulting basis during design to provide a fresh set of eyes and reduce potential change orders once the work is bid out. He characterized the idea as nearly a "construction manager at risk light."
Committee members pressed for details about procurement and legality. Commissioner Capitan asked whether such early contractor involvement would create an unfair advantage for bidders; Speaker 4, in a staff/legal capacity, said a narrowly scoped consulting engagement is legally permissible if it does not give the consultant an opportunity to bid on the project. The presenters said they would continue the conversation with the state’s attorney's office to document safeguards.
The committee also discussed the role of the human services zone in the new layout. Presenters said human services remains the largest user of the reconfigured space and that recent state policy changes (referenced in the meeting as "HR 1") have led to an increase in state-authorized FTEs, which affects how much space the department will need.
Members asked staff and JLG to return with examples of similar consultant uses and to brief the full commission in about two weeks. One commissioner suggested sending an official letter to the head of human services to clarify the county’s expectations for space and any request for state cost-sharing as legislative and regulatory changes alter staffing and compliance requirements.
The committee did not take a formal vote on the contractor-review proposal; staff said they would gather precedent examples and legal guidance and return with recommendations to the full commission.
