Committee updates policy-setting rules to increase transparency and public notice

The Policy Management Committee reviewed proposed revisions to Policy BFA, the district’s policy-setting rules, on Dec. 3, endorsing language that expands public transparency and clarifies procedures for notifying the board about regulations under development.

Sally Davis, supervisor of policy and regulations, told the committee the draft reworks portions of the policy to emphasize a continuously updated Summary of Changes page and a public-comment webpage that staff said is actively promoted to principals, the board and the community. "That summary of changes goes back to 2006, 2007. It's everything that has been amended, updated, revised, rescinded," Davis said.

Board members asked staff to clarify wording across the draft (examples included the phrasing 'not fewer than' and the sequence of when the committee solicits input from the superintendent), to be explicit about who 'those affected' are (the MCPS community), and to add a clear instruction that the superintendent or staff must notify the public when regulations are published for comment. Members also proposed a minimum public comment window; the committee discussed a minimum of 10 business days, and the chair agreed to request clearer language on comment-period timing.

Committee members also raised oversight questions about implementation, proposing that the policy committee may request implementation reports and spot checks of important policies to ensure written rules match practice. Staff agreed to add clarifying language and to make the work-plan process and annual review responsibilities clearer.

The committee voted unanimously to forward the BFA revisions to the full board for tentative action. Anuva Malu moved the motion and Sally Davis seconded. Staff will return to the full board with language edits and clarifications requested by committee members.
