MCPS committee advances new background-screening policy to full board

The Montgomery County Public Schools Policy Management Committee on Dec. 3 reviewed a new background-screening policy designed to centralize fingerprint-based checks and related safety measures for employees, applicants, contractors and certain volunteers.
"This policy establishes the requirements for fingerprint-based checks of national and state crime databases and sets forth guiding principles for additional safety measures," Caelan Connolly, MCPS Chief Talent Management Officer, told the committee during the presentation.
Staff described five core safety components: (1) fingerprint-based background checks, (2) ongoing monitoring through the FBI Rapback program, (3) reference checks with former employers, (4) mandated-reporter training on recognizing and reporting child abuse and neglect, and (5) verification checks by Montgomery County Child Protective Services. Sally Davis, supervisor of policy and regulations, said the draft is framed within applicable federal and state law.
Board members pressed staff on wording and enforceability, asking why some provisions use 'shall' while others use 'will' or 'may.' "There isn't an intended difference, and we can certainly clean that up before the draft comes back to the full board," Davis said. The committee asked staff to standardize verb choices and to clarify language so the policy reads clearly as guidance and as enforceable obligations where intended.
The committee then voted to forward Policy GCC to the full board for tentative action. Anuva Malu moved the motion and Chair Julie Yang seconded; the committee chair called the vote and said the motion was unanimous.
The policy will return to the full board with staff edits addressing verb consistency and other drafting issues; no final board action was taken at the committee meeting.
