Plan Commission approves Holland 3-Lot primary plat amendment and raises developer guarantee to $20,777.88

The Monroe County Plan Commission on November 1 approved changes to the Holland 3-Lot subdivision that let the built road remain at 26 feet and raised the developer’s performance guarantee to $20,777.88 to cover outstanding sidewalks, street trees and other public improvements.
Staff told commissioners the three-lot subdivision was recorded in July 2019 and still has unfinished public improvements, including sidewalks along South Walnut Street Pike, street trees and ADA-compliance issues at two driveways. Staff also reported possible conflicts with Smithville’s fiber duct that may require field spotting and, if a conflict exists, relocation work at the developer’s cost.
Planning staff recommended approval of the primary plat amendment and the inflation-adjusted guarantee, subject to conditions. The conditions include corrective measures to the driveways for Lots 1–3 so the developer of Holland Fields Phase 1 can complete the East Holland Drive sidewalk corrections, and the developer must apply for right-of-way activity permits and complete the work on or before May 1, 2026. For the financial guarantee, the commission required that a performance bond document be signed and recorded and that a new financial guarantee in the form of a letter of credit or cashier’s check satisfying $20,777.88 be submitted by Dec. 11, 2025.
The commission moved to hear the primary-plat amendment (case SMN-25-5) before voting on the inflation-adjusted guarantee (case SIA-22-18). After hearing staff’s presentation and noting that the petitioner’s engineer and attorney were not present, the commission approved the primary plat amendment with a waiver of the final hearing by roll-call vote 7–0, and subsequently approved the adjusted guarantee amount 7–0.
Commissioners discussed engineering and permitting steps that remain and stressed the need to verify Smithville’s conduit locations before lowering sidewalks where utilities may conflict. Staff said locators can be unreliable where rebar or other interference exists and that onsite spotting by the contractor would be needed to confirm conflicts and trigger any relocation estimates from Smithville.
The approvals carry conditions intended to ensure the public improvements are completed and accepted into the county inventory only after the required corrective work and permits are finished.
What’s next: The developer must submit the required financial guarantee by Dec. 11, 2025, and complete the driveway and right-of-way corrections by May 1, 2026, to move toward acceptance of the public improvements.
