Moraine council asks staff to draft ordinance creating 'minor maintenance' right-of-way permit

Law Director introduced the proposed language, saying the change "would be a minor maintenance permit" and explaining the goal is to reduce repeated reapplications for work that does not disturb pavement or require excavations. She said the language is intended to make the process more efficient and that "if for some reason we see that tweaks need to be made to this, obviously, we'll bring it back."
Council moved to have legislation drafted for the next meeting and approved the request by roll call. The council members recorded in the roll call were Mayor Murphy, Mr. Miller, Mr. Doherty, Mr. Bridgette, Mrs. Witt and Mrs. Allen; all voted yes.
The ordinance change as described would be added to codified ordinance section 901.22. The Law Director and city staff said the proposed permit is intended for applicants who need access to the right of way but will not make a cut in the roadway; the exact permit text and administrative procedures will be provided with the draft ordinance at a future meeting.
Next step: staff will prepare and present draft legislation at the council's next regular meeting for consideration.
