Cabell Drive homeowners get setback exception to preserve tree and build privacy wall

Patricia and David Draken asked the Port St. Joe planning board for a setback exception so they can place a house and an 8-foot privacy wall on their Cabell Drive lot without removing a large, mature tree. "We have a lot on Cabell Drive, that we would like to build a house on...we are asking for, an exception to the setback on the west side of the house. 4 feet," Patricia Draken told the board.
The applicants said the house placement is constrained by a large tree and a drainage canal at the rear; they proposed a walled patio and an 8-foot privacy barrier in the southwest corner to screen nearby RV rental sites on the other side of the drainage canal. The Drakens explained the wall would intrude into the required setback only at the southwest corner.
Staff and board members discussed the application and indicated the packet provided enough information for a decision. April from the building department and an unnamed planning staff member noted other site details (existing adjacent uses and drainage) and did not raise objection on the record. After brief discussion the board called for a vote; the transcript records verbal assent ('Aye') and the item was closed.
The board did not record a roll-call vote or attach conditions on the record in the transcript. The Drakens were advised to follow the normal permitting and inspection process with the building department to implement the approved setback exception.
