The Village of Salem Lakes voted to approve a termination and limited release of a recorded 1993 land‑division agreement that had required extending Dells Road and sanitary sewer across a Bayer Development parcel.
A representative for Bayer Development explained the property is encumbered by a recorded agreement requiring the full extension of Dells Road and sanitary sewer along the northern boundary. The developer said recent changes — including an improved pedestrian path and a permanent barrier along part of Dells Road — mean the full extension is unnecessary for the revised plan, which proposes three home sites served by existing improved pavement and utility stubs.
The board clarified the release was intended only to remove the obligation to extend the public road and sanitary sewer (not to void unrelated provisions of the 1993 agreement). Trustee Hopkins made the motion to approve the termination and release; Trustee Gant seconded. The motion passed on a voice vote.
Board members and staff noted that the village will still require any necessary improvements to serve the proposed lots and that development plans must follow standard subdivision and permitting requirements.
