Town attorney says foreclosure on troubled recycling site remains possible after performance plan

Town Attorney Horowitz updated commissioners on enforcement action against A and B Recycling (owner Gerald Anderson). The town had received authorization from a magistrate to pursue foreclosure of code liens but, minutes before that hearing, the property owner and new counsel agreed to a performance‑improvement plan that the town accepted as an alternative to immediate foreclosure.
Horowitz said building-administration staff will reinspect the property; if the inspection does not show satisfactory remediation, the town intends to file foreclosure actions and follows statutory foreclosure and auction procedures to recoup cleanup and administrative costs. He warned that environmental cleanup can be "insanely expensive" and that the town would take environmental conditions into account in any mitigation plan.
Commissioners asked staff to check the property regularly; Horowitz said reinspection is scheduled and foreclosure remains the intended remedy if the performance plan is not met.
