Board adopts resolution to deem volunteers employees for workers' compensation

The board unanimously adopted Resolution No. 10 on Dec. 9, which authorizes the district to deem volunteers to be employees solely for purposes of workers' compensation under California Labor Code section 3364.5 and related Education Code provisions as presented by Dr. Jason Rose.
Dr. Rose explained that the resolution aligns volunteer injury claims to the workers' compensation system so volunteers receive consistent coverage and prompt medical care while limiting civil-liability exposure for the district. He said the change is recommended by the JPA and noted that it would make the workers' compensation system the sole remedy for injured volunteers. The board asked clarifying questions about who qualifies as a volunteer, whether JPA rates would increase and what training or orientation volunteers must complete.
Staff responded that 'volunteer' covers parents, classroom helpers, traffic safety volunteers and other community members who serve on campus and that the JPA expects only a small increase in cost. Starting Jan. 1, volunteers will be required to complete the same orientation that employees complete before serving on campus. Dr. Rose said the JPA believes internships involving students will also be covered under this change.
Board members expressed interest in minimizing liability and ensuring volunteers understand training requirements. The motion to adopt the resolution carried by a unanimous roll call vote.
