City staff told the magistrate that an initial inspection was completed on Nov. 4, 2025; a repeat-violation notice and hearing notice were posted on-site Nov. 5 and certified mail was signed by the registered agent on Nov. 8, 2025, while mail to the LLC was returned as "vacant." Staff said no permits have been applied for since the notice, and identified a prior adjudicated matter (case 21-29) involving the property.
The city asked the magistrate to require the respondent to obtain the necessary building permits and to impose administrative costs and repeat-violator fines. The magistrate found repeat violations of Titusville code (construction/alteration permits required) and ordered the respondent to apply for and obtain the required permits. He said administrative costs in the amount of $136.28 shall be included in the order. On the record the magistrate stated a compliance date, saying "I think it was January 9" and said fines of $500 per day would commence on Jan. 10 and continue until the violation is corrected; the magistrate also said the certified order may be recorded in the public records of Brevard County.
