The Marion County Board of Commissioners voted Dec. 17 to accept an appeal of the Planning Commission’s approval of subdivision variance case 25-001 (Olander).
Staff explained the application proposes conceptual and detailed approval to subdivide a 24.6-acre parcel into seven lots and a variance to allow seven dwellings accessed off a private lane in an AR-3 zone. The Planning Commission approved the proposal on Nov. 4, 2025, and a neighbor appealed, presenting new arguments about potential stormwater and traffic effects tied to the additional dwellings allowed by the variance. Staff recommended the board accept the appeal.
Planning staff acknowledged that the Planning Commission hearing had been held in a different room because of construction at Salem City Hall and that using the boardroom for that hearing may have led attendees to misunderstand when testimony was appropriate. The staff member said that decision to use the boardroom was, in hindsight, an error that likely contributed to confusion.
Following staff comment and brief commissioner discussion on notification and quorum/procedural questions, a motion to accept the appeal was made, seconded and approved by voice vote. The board directed that staff and legal analyze notice procedures and that the record be revisited as part of the appeal process.
