The Apopka Planning Commission on Dec. 9 recommended approval of a special exception to permit outdoor storage on two parcels at 95 and 135 Herman Smith Road.
Planner Amir Hamza told the commission the combined site totals roughly 12.26 acres, has a light-industrial zoning classification and a future land use of industrial. The Development Review Committee recommended approval, and Hamza walked commissioners through the special-exception review standards in the city’s land development code.
MacGregor Love, attorney for the applicant, told the commission one of the parcels currently operates as a garage repair business and the other is vacant. He said both uses are legally nonconforming today but that, if the special exception is approved and the site is developed, the project would be brought into code compliance and the nonconforming status would be abandoned.
Commissioner Ryan asked about legal notice timing; Hamza said the local code requires a 14-day newspaper notice before the hearing. With no public speakers, Commissioner Mott moved to approve the special exception subject to the staff report’s exhibits and findings; Commissioner Wood seconded. The commission approved the motion on a voice vote.
The commission’s recommendation goes to the City Clerk and will be reflected in the staff report and packet sent to City Council if the matter proceeds to a council hearing.
