Staff told the council the applicant requested operation hours of 7:30 a.m. to 6 p.m. with a maximum enrollment of 60 students. Planning staff and the Planning Commission recommended approval with four conditions: that the conditional‑use approval does not constitute approval of a site development plan (any changes require a site plan and code compliance); the conditional use is valid only while the initial certificate of use remains active (a change in ownership or expiration requires a new conditional use); the council may review or revoke approval if stacking, drop‑off or safety issues affect traffic in the public right‑of‑way; and before issuance of any certificate of use the applicant must obtain a site variance (city council variance) to convert the designated common open space to private use and must obtain permits to regularize an existing unpermitted fence.
Nicole Morales, the applicant, told the council the fenced playground area is the courtyard between the two buildings (not the rear wetlands) and said she is taking steps to secure the variance and bring the fence up to code. Councilmembers asked clarifying questions about the fence location, safety measures for children and the requirement that the property owner participate in the variance request. Councilmember Paul moved to approve the resolution and Deputy Mayor Gilbert seconded; the motion passed 5‑0 by roll call.
Next steps: the applicant must file the variance application with required notice, bring the unpermitted fence into compliance and secure any required building/fence permits before a certificate of use will be issued. The council also retained the right to revisit the conditional use if stacking or traffic problems arise.
