The Fruita Housing Authority on Dec. 16 considered Resolution FHA 20‑25‑08, a ground‑lease option giving IndieBuild LLC an exclusive one‑year option to pursue LITEC funding and, if successful, negotiate a 50‑year ground lease for affordable housing on property identified adjacent to Fruita Muse. Counsel summarized terms including a $2,000 payment for the first‑year exclusive option and the ability to renew up to four times with additional payments and authority consent.
Mary Elizabeth (authority counsel) told the authority the parties had negotiated terms following an earlier reimbursement agreement and that IndieBuild intends to apply for LITEC funding in February. "IndieBuild will pay $2,000 upon the execution of this agreement for that first year exclusive option," she said, adding that renewals would require additional payment and authority approval.
After questions and discussion, a motion to approve the ground‑lease option was moved and seconded. The roll‑call vote produced a tie; the chair cast the deciding vote "no," and the motion failed. The transcript records the vote as split and that the chair’s tiebreaking "no" resulted in the resolution not passing. No further action was taken at the meeting.
