"Tonight's request is a conditional use permit to construct a new drive‑through restaurant," Morissette said during the staff presentation.
The developer’s design team, represented by Susan Jones of SJ Design Group, said the project would also fund improvements to the adjacent mobile home park, including additional parking and carports. Jones described typical operations and deliveries, and said the franchisee’s drive‑through delivery pattern produces short on‑site dwell times.
Residents who live in the adjacent mobile home park urged the commission to delay approval. James McGillis, a Simi Valley resident, told commissioners the proposal "fits a 10‑pound project into a 5‑pound bag," raising concerns about visibility at the raised pad, employees competing for limited parking, and overnight deliveries. Mary Reeves, a mobile‑home resident, described the park as home to many senior residents and said she expected deep‑frying odors, light and delivery noise to "permeate into our homes," asking the city and developer to increase mitigation beyond the proposed six‑foot wall.
Staff and the applicant responded that lighting would be hooded and shielded and that submitted photometrics show light levels would read zero beyond the property line; staff noted that odor and acoustic filtration must meet applicable city standards. The city’s traffic engineer characterized the proposed single consolidated driveway and reduced curb cuts as a safer configuration than the existing layout and said the applicant’s traffic study estimated roughly 423 average daily trips.
During deliberations commissioners debated whether the commission should deny the single‑lot proposal and instead seek redevelopment of both Lots 1 and 2 to address nonconforming uses and avoid displacing mobile‑home residents. A motion to deny the project failed for lack of a majority after discussion and an abstention were recorded.
The applicant offered concessions on several items: a representative said the owner was "amicable to agreeing to the 10 AM to 10 PM" hours of operation and to deliveries no earlier than 5 a.m., and that the standard six‑foot block wall could be increased to eight feet. The applicant did not commit to changes to mechanical filtration without consulting engineers.
After a short recess to consult legal counsel, the commission moved to continue the conditional use permit (CUP‑SD‑2024‑0002) to a date certain of Jan. 21, 2026 to allow staff and the applicant to work with the neighborhood on issues including wall height, odor mitigation, traffic circulation and delivery/hours conditions. The motion to continue passed unanimously.
Next steps: staff will work with the applicant to address the concerns raised and return to the commission on the scheduled Jan. 21, 2026 date. The item would be subject to normal appeal periods and any final action could be appealed to city council if required.
