Staff explained that the pie‑shaped lot, steep rear grade and nearby arroyo limit developable area and constitute a physical hardship under variance criteria. The parcel is slightly more than one acre and lies at the end of a cul‑de‑sac; staff said no letters of opposition were received and recommended approval subject to adherence to building codes and engineered foundation drawings.
Applicant Joel Race said he had consulted with adjacent neighbors and obtained letters of support. Staff noted required steps for septic and water approvals through the New Mexico Environment Department and that permit applications would be routed to relevant departments for review.
Commissioner Lier moved to approve the variance based on staff findings; the motion passed on roll call with unanimous support from commissioners present.
