Council approves release of stormwater debt for Exposition Gardens after divided debate

Councilmember Cyr objected to writing off the debt, saying he "can't vote for this and just sweep it under the carpet," and moved to deny forgiveness. Corporation Counsel Hayes explained the bank had a $201,000 deficiency judgment in the prior foreclosure and the city acquired the property; stormwater liens and subsequent accruals brought the total owed to more than $480,000. Staff said the bank and city had opportunities to resolve the deficiency and that the Exposition Gardens Authority currently lacks operations and revenue.
The initial motion in the negative failed. Council then took the affirmative step to approve release of the remaining debt; the council clerk recorded the final vote and the motion passed with several recorded no votes. Supporters said carrying the debt on the books generates ongoing legal costs and is likely futile; opponents said forgiving the obligation could remove future leverage and accountability.
Council asked staff to continue evaluating whether any recoveries or other legal remedies are possible and to provide further details if available. The vote concluded with instructions from counsel that the council should act with a positive motion when granting release (parliamentary clarification Hayes provided during debate).
