The Hardin County Commissioners Court on Dec. 9 approved an amendment to the county’s Subdivision Manual that removes an exception in Article 3 and adds a new Article 4 provision to align replat notifications and fees with state law.
Floodplain Administrator Alex Parker explained the change is intended to close a loophole that previously allowed owners to divide large tracts into smaller parcels on private roads without meeting minimum private-road requirements. Commissioner Young said the configuration of some properties predated the current regulations and staff had consulted with the county attorney to confirm the change.
The amendment adds a new administrative fee of $160 for replat review and requires applicants to pay $8 for each required certified or registered letter, plus reimbursement of any engineering review costs, referencing Local Government Code provisions cited in the presentation. Commissioner Young said the change is ‘‘just covering our cost’’ and will bring the manual into alignment with statute.
The court voted to adopt the amendment and the fee structure. The judge indicated the office is prepared to implement the new process and planned to place the item on the next agenda for finalization where needed.
The action affects future replat submissions and ensures adjacent landowners receive statutorily required notification and that the county recovers administrative review costs.
