Stephenson County board discusses late fees, pending lawsuit and vendor interest claims

A board member identified as Ashley said the county has been unable to complete certain transactions because of a lawsuit she described as mistaken and prolonged, and she asked whether the county could seek damages to cover late fees if it prevailed. "If they lose, I want them to have to pay for it so that they don't do it again," the speaker said.
County staff advised the board to consult with county legal staff (referred to as Carl in the meeting) before pursuing damages and suggested the board could consider an executive session for a more detailed discussion. Staff also said many of the outstanding vendor payments could likely be processed by Jan. 2 regardless of the lawsuit's outcome.
During the discussion, staff reported that a vendor from Lender's Tree Service presented a statement that morning showing approximately $131,400 in interest owed on a bill the vendor said was under $7,500. Board members questioned whether state law or the county's contract limits vendor interest; one member said a 2% contract term might apply and asked staff to check the applicable statutory and contract language.
After discussion, the board voted by voice to approve the claims. The meeting record shows the board chair called for the voice vote and the motion carried.
Next steps: staff said they would follow up with legal counsel (Carl) on options regarding the lawsuit and interest claims, and staff will verify contract terms and state rules on allowable interest rates for government vendors. The board did not take further formal action on damages at the meeting.
