FPPC adopts Form 700P prompt to require disclosure of prospective employment for high-level filers

The California Fair Political Practices Commission on Nov. 20 voted to adopt staff's recommendation to add a Form 700P attachment prompting certain high-level filers to disclose any arrangement for prospective employment.
Chloe Hackert, manager of the education and external affairs unit in the legal division, told commissioners the change responds to AB 1286 (staff referred to it as AB 12 86) and SB 852 and that the FPPC, as filing officer for section 87200 filers, can implement the prompt in its e-filing system. "Staff recommends Option 1 of the prospective employment with the Form 700P attachment," Hackert said, adding that vendors and stakeholders — including Granicus and CalSTRS — favored the attachment because it limits confusion for filers who are not in the narrower subset required to report prospective employment.
Commissioners asked about broader filing suggestions and implementation. Executive Director Galena West said the agency collects comments year-round and will roll reasonable improvements into future updates. After discussion, Commissioner Brandt moved and the commission voted in favor of Option 1.
The change takes effect for electronic filers the commission oversees and will be accompanied by outreach, a fact sheet and training from the FPPC's SEI unit.
What this means: Section 87200 filers (the state category described in the presentation) will see a prompt in the FPPC's e-filing portal asking them to complete the Form 700P attachment when relevant. Hackert said the prompt should reduce accidental nonreporting and that the agency will expand education and training to support compliance.
The commission voted to adopt the update by a recorded voice vote; staff said the e-filing vendor Granicus confirmed the attachment approach was straightforward to implement.
Next steps: The FPPC will finalize the Form 700P materials and roll out guidance and training for affected filers ahead of the next reporting cycle.
